1. Terms of Service (Towing & Roadside Assistance)
Effective Date: November 20, 2025
Company: NXT Roadside assist & Recovery (“NXT Roadside assist ,” “we,” “our,” “us”) By requesting service from NXT Roadside assist, you agree to the following terms:
Service Authorization
The customer authorizes NXT Roadside assist to provide towing, roadside assistance, vehicle recovery, winch-out, or storage services as requested. The customer affirms they are the owner of the vehicle or have legal authority to request service.
Vehicle Condition
NXT Roadside assist is not responsible for pre-existing mechanical issues, hidden damage, or structural defects that may worsen during transport or recovery.
Roadway & Recovery Conditions
Customers understand that difficult conditions (snow, ice, mud, off-road locations, steep angles, unsafe vehicle condition, etc.) may require specialized equipment or additional charges.
Right to Refuse Unsafe Requests
NXT Roadside assist may decline any service that is unsafe for the operator, public roadway, or vehicle.
Payment
Payment is due at the time of service unless other arrangements have been approved in writing.
Delays
Arrival times are estimates based on traffic, weather, and call volume.Storage Vehicles towed to NXT Roadside assist property may incur daily storage fees according to our posted rates.
Governing Law
These terms are governed by the laws of the State of Utah.
2. Privacy Policy
NXT Roadside assist is committed to protecting your privacy. This policy explains how we collect and use your information.
Information We Collect
We may collect:
- Your name
- Phone number
- Pickup/drop-off location
- Vehicle information (make, model, condition)
- Payment information
- Insurance details (if applicable)
How We Use Your Information
We use this information to:
- Dispatch service
- Communicate about your tow or roadside assistance
- Process payments
- Coordinate with insurance or law enforcement (when required)
Information Sharing
We do not sell or rent your personal information. We may share information only with:
- Insurance companies (upon your request or when required)
- Law enforcement (if legally required)
- Payment processors
- Motor vehicle storage facilities
- Partner service providers (if we subcontract, with your permission)
Data Security
We use reasonable safeguards to protect your information from unauthorized access.
Your Rights
You may request copies of any personal information we hold or ask us to delete it, unless required for legal or business purposes.
3. Release of Liability / Damage
Disclaimer
By requesting service from NXT Roadside assist , the customer acknowledges:
Mechanical & Pre-Existing Damage
NXT Roadside assist is not responsible for mechanical failures or pre-existing damage that may become apparent during towing or roadside assistance. Examples include but are not limited to:
● Transmission or drivetrain issues on AWD/4WD vehicles
- Brake or steering failures
- Damage caused by rust, corrosion, or poor vehicle condition
- Hidden frame damage
Difficult Recovery Situations
In situations such as snow, mud, ice, sand, steep terrain, blocked wheels, or damaged suspension, additional risk exists. Customer accepts responsibility for any further damage that occurs as a result of necessary recovery procedures.
Personal Property
NXT Roadside assist is not responsible for loss or damage to personal items inside the vehicle.
After-Hours Release
Vehicle pickup or release may be limited outside business hours. Storage fees may apply.
4. Billing Transparency Statement
NXT Roadside assist believes in honest, upfront pricing. Here’s how we protect you:
Clear Pricing Before We Begin
- You receive a quote before service is provided.
- Any additional fees (long-distance, winch-out, accident recovery, after-hours, storage)
will be explained clearly.
No Hidden Fees
We do not add surprise charges after the fact. All standard rates are disclosed upfront. Mileage & Equipment Charges Long-distance towing, winch-outs, and special equipment may involve additional charges that are communicated prior to service.
Payment Methods
We accept:
- Credit/debit cards
- Cash
- Approved insurance/roadside dispatch orders
Invoices & Receipts
A digital or printed receipt is available upon request for insurance reimbursement or personal records.
5. Vehicle Storage Policy
NXT Roadside assist Roadside & Recovery (“NXT Roadside assist ”) provides short-term and long-term vehicle storage subject to the following terms:
Storage Authorization
Vehicles may be placed into storage at the request of the vehicle owner, property owner, law enforcement, or NXT Roadside assist following a tow.
Storage Fees
Daily storage rates apply beginning at the time the vehicle enters NXT Roadside assist property. Rates vary by vehicle type, size, and storage duration. A full list of fees is available upon request.
Access to Stored Vehicles
Release or access to stored vehicles is available during posted business hours only. Valid government-issued ID and proof of vehicle ownership are required.
Unclaimed Vehicles
Unclaimed vehicles may be processed under Utah Code § 72-9-603 for abandoned vehicle procedures, including lien notifications and eventual sale if not retrieved.
Personal Property
NXT Roadside assist does not inventory personal belongings inside vehicles. We are not responsible for personal items left in the vehicle.
6. Vehicle Release Policy
To release a stored or towed vehicle, the following is required:
Required Documents
- Valid government-issued ID
- Proof of ownership (registration, title, insurance, or bill of sale)
- Payment of all towing, storage, and administrative charges
Authorized Pickup Only
Vehicles will only be released to the legal owner or an authorized agent with written consent.
Hours of Release
Vehicles can only be released during NXT Roadside assist posted business hours unless otherwise arranged.
Hold Situations
A release may be delayed if:
- Law enforcement has placed a legal hold
- Insurance authorization is pending
- Ownership documentation is incomplete NXT Roadside assist complies fully with law enforcement and insurance company instructions.
7. Abandoned Vehicle & Lien Notice
Policy (Utah-Compliant Structure)
NXT Roadside assist follows all state-mandated procedures for abandoned or unclaimed vehicles stored on our property.
Lien Procedures
If a vehicle remains unclaimed beyond the statutory period, NXT Roadside assist will:
- Issue a mailed notice to the registered owner and lienholder.
- File the required notice with state systems.
- Assess storage fees as allowed by Utah law.
- Proceed with lien sale procedures if the vehicle remains unclaimed.
Owner Responsibility
Owners are responsible for all towing, storage, administrative, and lien-processing fees.
Stopping the Process
Owners may reclaim the vehicle at any time before sale by paying all accrued charges and providing proper documentation.
8. Accident Towing Consent Language
When NXT Roadside assist provides accident or collision towing:
Customer Acknowledges:
● Law enforcement may direct where the vehicle can be moved.
- Additional cleanup or recovery fees may apply for debris, spilled fluids, or complex recoveries.
- Insurance companies may reimburse towing costs depending on coverage.
Tow Destination
Unless directed otherwise by law enforcement or insurance, vehicles are transported to:
- The customer’s chosen repair facility, or
- NXT Roadside assist storage yard for temporary secure holding.
9. EV / AWD / Modified Vehicle
Disclaimer
Certain vehicles require special care.
Electric Vehicles (EVs)
NXT Roadside assist uses flatbed towing for all EVs when conditions allow. Customer acknowledges that:
- Some EVs may enter “park lock” conditions requiring special procedures.
- Towing with damaged battery packs may require longer wait times or specialized equipment.
AWD / 4×4 Vehicles
AWD vehicles must be towed on a flatbed to avoid drivetrain damage. Mechanical failure unrelated to towing is not the responsibility of NXT Roadside assist.
Lowered / Modified VehiclesWe make every effort to tow modified vehicles safely, but:
- Extremely low vehicles
- Aftermarket body kits
- Custom suspensions
…may increase the risk of scraping or damage. Customer accepts this risk.
10. NXT Roadside assist Professionalism &
Conduct Promise
NXT Roadside assist is committed to safe, respectful, and professional service.
Our Operators Promise:
- Courteous, respectful communication
- Clear explanation of procedures and pricing
- Safe handling of your vehicle
- Clean equipment and properly maintained trucks
- Professional conduct at all times
No Harassment or Abuse
NXT Roadside assist maintains a zero-tolerance policy for improper conduct. Operators have the right to decline service if the environment is unsafe or hostile.
11. NXT Roadside assist Service Guarantee
NXT Roadside assist stands behind every tow and roadside service. We Promise:

If you ever feel NXT Roadside assist did not meet this standard, please contact management so we can review and address the concern immediately.
12. Special Equipment & Conditions Disclosure
NXT Roadside assist may use special equipment for difficult recoveries including:
- Winch-outs
- Soft-strap tie-downs
- Dollies
- Recovery boards
- Heavy-duty chains
- Snow/ice traction equipment
Additional charges may apply if:
- Vehicle is stuck off-road
- Car slid into a ditch, snowbank, mud, or embankment
- Vehicle is missing wheels
- Tires are flat or unsafe
- Doors are locked and keys are inaccessible
- Vehicle is overturned
All fees are disclosed upfront whenever possible.
